1. Rental Payment and Security Deposit<\/h2>

The total rental amount must be paid before vehicle pick-up.<\/p>

In addition, the renter must provide a \u20ac900 security deposit to guarantee the proper use and return of the vehicle. This deposit must be made by VISA credit card or by the method indicated by Tu Casa N\u00f3mada. <\/p>

The motorhome is covered by fully comprehensive insurance with a \u20ac900 excess.<\/p>

The security deposit will be refunded within a maximum of 48 hours after the vehicle is returned, provided it is returned without dents, damage, defects, missing items, or breaches of these conditions.<\/p>

If any damage, defects, or incidents are detected, the corresponding amount will be assessed and deducted from the deposit. If the damages cannot be assessed immediately, Tu Casa N\u00f3mada will have a maximum period of 30 days to estimate the repair costs and refund the remaining balance of the deposit, if applicable. <\/p>

2. Vehicle Delivery Due to Force Majeure<\/h2>

If, due to force majeure, unforeseen circumstances, breakdown, accident, or damage not attributable to Tu Casa N\u00f3mada, the vehicle cannot be delivered on the agreed date, the renter shall not be entitled to claim compensation.<\/p>

Force majeure shall include, among other cases, breakdowns or accidents preventing the vehicle from being available or repaired by the agreed delivery date.<\/p>

3. Late Start or Early Termination of the Rental<\/h2>

If the renter decides to start the rental late or end it before the agreed date, no refund or reimbursement will be given for unused days or hours.<\/p>

4. Minimum Age and Driving License<\/h2>

The minimum age to drive the vehicle is 25 years old.<\/p>

Persons under 25 years old traveling in the motorhome may not drive the vehicle. The renter is responsible for ensuring compliance with this condition. <\/p>

The driver must hold a valid and current driving license suitable for the rented vehicle.<\/p>

5. Pick-Up and Return Location and Schedule<\/h2>

Vehicle pick-up and return will take place in Galdakao, at the address or location indicated by Tu Casa N\u00f3mada.<\/p>

The vehicle must be returned on the agreed date and time stated in the rental agreement. Unless otherwise agreed, the return must take place before 8:00 PM. <\/p>

6. Permitted Use of the Vehicle<\/h2>

The vehicle must be used responsibly, in accordance with applicable laws, traffic regulations, and these conditions.<\/p>

The following are expressly prohibited:<\/p>

  • Using the vehicle for activities contrary to the law, public morals, or good customs.<\/li>
  • Carrying more passengers than legally permitted.<\/li>
  • Participating in races, competitions, sporting events, or similar activities.<\/li>
  • Transporting unauthorized goods or objects.<\/li>
  • Assigning, subletting, or lending the vehicle to third parties, whether free of charge or for payment.<\/li>
  • Using the vehicle for purposes other than tourist or recreational rental use.<\/li><\/ul>

    7. Fines, Penalties, and Renter Responsibilities<\/h2>

    The renter shall be responsible for any fines, penalties, surcharges, tolls, complaints, or expenses arising from the use of the vehicle during the rental period.<\/p>

    If, due to the renter\u2019s actions or fault, the vehicle is seized, immobilized, impounded, or otherwise unable to be used, the renter shall bear all resulting expenses, damages, losses, and loss of profit suffered by Tu Casa N\u00f3mada.<\/p>

    In such cases, the daily rental rate of the rented vehicle will be charged for each day the vehicle remains unavailable.<\/p>

    8. Vehicle Immobilization<\/h2>

    If the vehicle is immobilized solely due to the renter\u2019s fault, the renter shall be responsible for all resulting damages, expenses, losses, and costs.<\/p>

    9. Cleaning and Vehicle Return<\/h2>

    The vehicle must be returned in good condition, clean, and hygienic.<\/p>

    In particular, it must be returned:<\/p>

    • With the interior cleaned.<\/li>
    • With the chemical toilet emptied and cleaned.<\/li>
    • With grey water and waste water tanks properly emptied.<\/li>
    • Without rubbish, waste, or food remains.<\/li>
    • With all accessories and items delivered at the start of the rental.<\/li><\/ul>

      Otherwise, the renter accepts a fixed penalty charge of \u20ac100, which may be deducted from the security deposit.<\/p>

      10. Rental Extension<\/h2>

      If the customer wishes to extend the rental beyond the agreed dates, they must notify Tu Casa N\u00f3mada at least 3 days before the end of the contract.<\/p>

      Extensions are always subject to availability and must be expressly confirmed by Tu Casa N\u00f3mada.<\/p>

      Unauthorized late returns not caused by force majeure will be penalized with a charge equivalent to triple the daily rental rate stated in the contract.<\/p>

      11. Insurance and Excess<\/h2>

      The vehicle is insured in accordance with current regulations and includes fully comprehensive insurance with a \u20ac900 excess.<\/p>

      In the event of an accident or claim during the rental period, the renter shall assume the amount of the excess and authorizes Tu Casa N\u00f3mada to deduct such amount from the deposited security deposit.<\/p>

      The renter shall be solely responsible for any liabilities, damages, costs, or losses not covered by the insurance policy or resulting from improper, negligent, or contract-breaching use of the vehicle.<\/p>

      12. Vehicle Inspection and Deposit Refund<\/h2>

      Once the vehicle has been returned, Tu Casa N\u00f3mada will inspect its overall condition, equipment, accessories, documentation, cleanliness, tanks, bodywork, interior, and other elements.<\/p>

      As the recreational vehicle contains multiple devices, furniture, accessories, and technical elements, Tu Casa N\u00f3mada reserves a period of 48 hours to carry out the inspection.<\/p>

      If damage, defects, missing items, or breaches are detected, the customer will be informed of the corresponding amount, which may be deducted from the deposit.<\/p>

      If the assessment of damages cannot be carried out immediately, Tu Casa N\u00f3mada will have a maximum of 30 days to determine repair costs and refund the remaining balance, if applicable.<\/p>

      13. Customer No-Show<\/h2>

      Failure of the customer to appear at the agreed place, date, and time for the start of the service shall be considered a unilateral cancellation of the contract and reservation by the customer.<\/p>

      In this case, a penalty of 100% of the rental amount will apply.<\/p>

      The no-show entitles Tu Casa N\u00f3mada to freely dispose of the reserved vehicle without the renter having any right to compensation, reimbursement, or refund.<\/p>

      14. Fuel and AdBlue<\/h2>

      The vehicle is delivered with full fuel and AdBlue tanks and must be returned in the same condition.<\/p>

      If Tu Casa N\u00f3mada needs to refill the fuel tank, diesel will be charged at \u20ac2.50 per litre, which may be deducted from the security deposit.<\/p>

      15. No Smoking Policy<\/h2>

      Smoking inside the motorhome is prohibited.<\/p>

      Failure to comply with this condition will result in a \u20ac100 penalty, which may be deducted from the security deposit.<\/p>

      16. Mileage<\/h2>

      The rental includes a limit of 300 km per day.<\/p>

      For rentals longer than 6 days, mileage will be unlimited unless another condition is expressly agreed in the contract.<\/p>

      If the included mileage is exceeded, additional charges indicated in the contract or booking conditions may apply.<\/p>

      17. Loss of Keys or Documentation<\/h2>

      Loss of keys, vehicle documentation, or any essential item required for vehicle use will result in a \u20ac200 penalty, which may be deducted from the security deposit.<\/p>

      If the actual replacement, management, or travel costs exceed this amount, the renter shall be responsible for paying the additional costs.<\/p>

      18. Reservations and Cancellations<\/h2>

      Vehicle reservations are confirmed by payment of a deposit equivalent to 30% of the total rental amount.<\/p>

      In the event of cancellation by the customer, the following penalties will apply:<\/p>

      • Cancellation more than 30 days before the start of the rental: 50% of the deposit paid will be forfeited.<\/li>
      • Cancellation between 30 and 16 days before the start of the rental: 80% of the deposit paid will be forfeited.<\/li>
      • Cancellation less than 16 days before the start of the rental: 100% of the deposit paid will be forfeited.<\/li><\/ul>

        19. Acceptance of the Conditions<\/h2>

        The reservation, payment, signing of the contract, or collection of the vehicle implies express acceptance of these Rental Conditions by the renter.<\/p>
